General Terms and Conditions / Terms of Payment

The following General Terms and Conditions / Terms of Payment (hereafter referred to as Terms and Conditions) apply to all orders, offers, deliveries, and services that are carried out. Specific data regarding an order cannot be called up on the Internet due to security considerations. The data will rather be handled confidentially in accordance with our Data Protection Conditions. The relevant version of the Terms and Conditions will apply.

1. Scope
The following Terms and Conditions apply solely to all contracts, deliveries, and other services - to the extent that they have not been modified or excluded through the express written agreement of the seller. Consultation, advice, and recommendations are always to be considered as nonbinding, informal, and gratuitous unless there has been an express written agreement to the contrary. Independent obligations cannot be created thereby. Conditions imposed by the buyer do not become binding even when the seller has not expressly taken exception to them once again.

2. Offer and Acceptance
A sales contract enters into effect once we issue a delivery confirmation. The prices are those in effect at the time of the order. Our offerings over the Internet (at our site) may be treated as a catalogue with price listings. If the seller enters into collateral agreements or warranties that go beyond the terms of the written sales contract, then these must always be confirmed in writing by the seller.

3. Delivery Deadlines and Delay
Goods that are in stock will be sent within 1-3 workdays after payment has been credited to our account. If the goods ordered are not in stock, then we will make every effort to make the quickest possible delivery. Delivery takes place with the reservation that 11freunde themselves receive delivery in a proper and timely fashion. The customer will be promptly informed if there is going to be a delay in delivery of longer duration. Delivery deadlines and dates are agreed to only as approximations unless the seller has made a written commitment that he expressly acknowledges as binding. No claim for damages exists – even in the case of late or incomplete delivery – unless there has been gross negligence. Partial deliveries are acceptable. The delivery deadline will be extended – even in the case of delay – as reasonable in case of force majeure and all unforeseeable hindrances that lie outside the power of the seller. This is also the case when such circumstances hold sway with the seller’s suppliers and their subcontractors. In important cases the seller will promptly inform the buyer of the onset and termination of such hindrances. If the seller is prevented from performing because of events of this nature then he is entitled to rescind the contract. The buyer may demand clarification from the seller as to whether he is withdrawing from the contract or intends to deliver within a reasonable period of time. If the seller does not issue a clarification then the buyer may withdraw from the contract.

4. Packaging, Shipping
There will be no special charge for packaging. The seller will ship goods in a manner so as to prevent breakage. The route and manner of shipping are left to the seller to determine. The seller will generally use a DHL Deutsche Post Euro Express package.

5. Prices and Shipping Costs
Prices represent the final price and are quoted in EUR inclusive of the statutory VAT, in addition to and if necessary, shipping costs.

6. Payment and Delay
Customers are provided with various payment methods. We offer the following options.

The prepaid shipping costs per item are:
Within Germany: 7 Euro handling costs.
Other EU nations, nations not belonging to the EU: Shipping costs available upon inquiry.

7. Reservation of Title
The seller retains title to the goods until all of his claims against the buyer have been met, whether arising from the business transaction – including claims arising in the future – or from contracts concluded at the same time or at a later date.

8. Warranty
11freunde provide a warranty for the statutory warranty period of 24 months. The period begins to run upon delivery of the goods.

9. Liability
The use of all content made available on this website takes place at the user’s own risk. Tom Lajko is not liable for any damages arising therefrom. Exceptions to this exclusion from liability are intentional acts and situations where liability is prescribed by statute. Any liability for damages on the part of Tom Lajko and his assistants – whether or not contractual in basis and regardless of its basis in law – is restricted to gross negligence and intentional acts. Damages for breach of important contractual duties are limited to foreseeable ones common to the type of contract entered into. This limitation applies to the extent that intention or gross negligence is not at issue, and to the extent that there is no liability for wrongful death, bodily injury, or damage to health.

10. Right of Revocation
Your order is no longer binding if you cancel within 2 weeks of receipt of the goods. In the case of an effective revocation, each party is to return or refund in order to recompense the other party for his performance. If the customer cannot return all or only part of the goods – or can only return them in a deteriorated condition – the seller may be entitled to compensation for lost value. Damages do not arise when goods have deteriorated merely because they have been tried out by the buyer, for example, in a retail shop. Damages for lost value can be avoided when the buyer does not treat the goods like an owner and refrains from activities that could affect their value. Items that can be mailed as parcels are to be returned in this manner. When goods are to be returned the seller is to use the original packaging (providing proof against breakage) that they were sent in.

Cancellation does not require statement of a reason. The buyer can inform the seller of cancellation in writing (through letter, fax, or email) or simply (by implication) in that he returns the goods. The two-week cancellation deadline will be met if the goods are mailed during this period to the address listed below. Once the goods have been returned in accordance with the deadline the sales contract will be rescinded and any payments the buyer has already made reimbursed. The seller bears the cost of returning the goods if the order’s value did not exceed that of 40 Euro.

11. Place of Performance, Place of Jurisdiction
Place of performance and the exclusive place of jurisdiction for merchants is Hamburg. German law applies.

Your personal data – including your home and e-mail addresses - will only be given to third parties with your express permission which you may revoke any time. The service providers who work with us provide an exception as they require data to process the orders. Shipping firms that have been entrusted with delivery and credit institutions that have been entrusted with processing payment are examples of such service providers. In such cases, the extent of the data released is restricted to the minimum amount necessary.

We have implemented security measures – both technical and within our organization – that protect the data you have provided from accidentally or intentionally being tampered with, lost, or corrupted. Our security system prevents unauthorized third parties from gaining access to your data.
